Selected highlights with respect to adjudicatory and regulatory matters include serving as counsel in proceedings leading to the court decision in Weinberg v. CedarsSinai Medical Center upholding a board of directors’ rejection of medical staff credentialing recommendations under a “great weight” deference test; successfully opposing injunctive relief sought against a medical staff based on claims that it had conspired to retaliate against a physician for advocating medically appropriate health care; advising Myriad Genetics, Inc., in protocols, consent, liability and confidentiality issues arising out of BRCA1 and BRCA2 genetic testing for breast cancer; successfully defending with associated counsel medical staff policies regarding suspected physician substance abuse in Goodstein v. Cedars-Sinai Medical Center; successfully defending with associated counsel the hospital and medical staff in the credentialing action terminating privileges in Rhee v. El Camino Hospital District; serving as co-counsel in the first successful certificate of need in California for additional beds; serving as a member of a national advisory committee on patient privacy; and serving as an editor of a widely-used consent manual.

Selected highlights with respect to transactional matters include representing the co-discoverer of HIV and a winner of the 2008 Nobel Prize in Medicine, Professor Luc Montagnier, and the Paris-based World Foundation for AIDS Research and Prevention in negotiations establishing a research center funded by Bernard and Gloria Salick at Queens College of the City of New York; advising clients in acquisitions, reorganizations and affiliations  including related charitable trust and inurement issues; negotiating workouts prompted by allegations of violations of fraud and abuse laws; representing numerous issuer/borrowers in tax-exempt financings; serving as co-counsel in the first transfer of a California local hospital district acute care hospital to an independent non-profit corporation; and representing the borrower in the first successful “unwinding” of a Revenue Ruling 63-20 tax exempt financing before the Internal Revenue Service.
